The legislation, which passed in the state House, would have required any health provider who performs or assists in an attempted abortion in which the infant is born alive to provide the ‘same degree of professional skill, care, and diligence’ to preserve the life that they would to any other child born at the same gestational age.
The act requires medical care for babies who survive attempted abortions.
While it’s difficult to gain ground in such states, ‘if you don’t try, the status quo will just stay forever,’ one veteran pro-life advocate stressed.
The bill, known as the Human Rights (Children Born Alive Protection) Bill 2021, would require medical practitioners to save the lives of children who survive abortions.
The new law is scheduled to go into effect in July.
Sens. Joe Manchin, D-W.Va., and Bob Casey, D-Penn., were the only two Democrats who joined Senate Republicans in supporting Sasse’s amendment.
The Born-Alive Infant Protection Act has been introduced countless times in Congress, but has failed to become law.
While Congress in 2002 passed the Born-Alive Infants Protection Act defining abortion survivors as people, Rep. Wagner’s 2019 bill gives an enforcement mechanism for the babies to receive necessary care.
